Bloomberg Law reports that Florida Attorney General James Uthmeier sought a preliminary injunction on September 28 to stop OpenAI and Sam Altman from releasing new AI models without third-party safety approval. Axios reports the motion alleges OpenAI collected personal information from children under 13 without parental consent and failed to adequately restrict minors’ access to ChatGPT. POLITICO says OpenAI has stood by its safety protocols while fighting the lawsuit.

Florida Attorney General James Uthmeier is seeking an emergency injunction against OpenAI, escalating the state’s legal fight over ChatGPT with new claims focused on children’s privacy and minors’ access to the chatbot, Axios reports.

According to Axios, the motion alleges OpenAI violated the Children’s Online Privacy Protection Act, or COPPA, by collecting personal information from children under 13 without parental consent. The filing also alleges that OpenAI lacks adequate measures to prevent minors from accessing ChatGPT.

The new motion builds on a lawsuit Uthmeier filed in June. Axios reports that the earlier case accused OpenAI of violating Florida’s Deceptive and Unfair Trade Practices Act, alleging the company was negligent and grossly negligent in the design, marketing, sale, promotion and distribution of ChatGPT.

That June suit also alleged that OpenAI failed to warn Floridians about ChatGPT’s dangers, misrepresented the chatbot’s safety and created a public nuisance by releasing it in Florida without proper safeguards, according to Axios.

The emergency request marks a sharper attempt by Florida to curb how ChatGPT is offered in the state while broader fights over AI regulation remain unsettled. OpenAI did not immediately respond to Axios’ request for comment.

Laura Loomer@LauraLoomer🚨 BREAKING 🚨 Florida Attorney General @AGJamesUthmeier Seeks Emergency Court Order To Restrict OpenAI and ChatGPT Florida Attorney General James Uthmeier has asked a court for a temporary injunction against @OpenAI OpenAI, arguing the company cannot safely manage ChatGPT @ChatGPT and that the product is harming users — especially minors. In the filing, the state of Florida, with attorney Ashley Keller from Keller Postman as counsel, alleges OpenAI has itself said government intervention is needed to slow AI development, that the technology has been tied to cyber incidents against private companies and government systems, and that ChatGPT deceptively influences users by mimicking human behavior, hiding errors, and stretching conversations to boost engagement and profits. The AG says those problems are worse for children and teens, who can access the product with little restriction and who, the state claims, have faced academic decline, isolation, and loneliness. This is what Florida wants the court to ban OpenAI from doing while the case is pending: • Developing new AI models without independent third-party safety guardrails • Offering ChatGPT to minors in Florida • Collecting data from children under 13 in violation of state and federal law • Calling ChatGPT safe or accurate, without clear warnings about its risks • Portraying ChatGPT as having human attributes • Designing ChatGPT to prolong conversations with users11d
